From GODWIN TSA, Abuja

The order of a Federal High Court restraining the Independent National Electoral Commission (INEC) from accepting or recognizing the name of Governor Theodore Orji as a candidate of the Peoples Democratic Party (PDP) for the April governorship elections in Abia State has not been vacated until February 27 when the court will deliver its judgment.

The court was unable to deliver its judgment in the suit yesterday on the ground that the presiding judge, Justice Gabriel Kolawole was pre-occupied with other official matters and therefore could not write his judgment.
The court did not also vacate its order directing the INEC from accepting or recognizing the name of Governor Theodore Orji as a candidate of the PDP for the April governorship elections in the state.

The court had also restrained the PDP and its acting National Chairman, Dr. Bello Haliru Mohammed or their agents and privies from submitting to the electoral body the name of any person other than that of the plaintiff and his nominated running mate in person of Dr. Chukwuemeka C. Okwuonu as candidate of the party for the office of governor and deputy governor of Abia State respectively at the 2011 general elections pending the hearing and determination of the motion on notice.
